1. Introduction & Acceptance of Terms
By creating an account on FCPOfolio or paying for any subscription, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. You must be at least 18 years old to use the Platform.
2. Definitions
"Platform" means FCPOfolio (fcpofolio.com) and all content and services made available through it. "Member" means any person with an account. "Content" means all text, charts, videos, briefs, data and other material published on the Platform. "Subscription" means any paid plan. "Billing Term" means the period you are billed for (monthly or annual).
3. Accounts
You agree to provide accurate registration information and to keep your login credentials confidential. Membership is per-seat: one natural person per account. Account sharing is prohibited, and we may suspend any account used in breach of this clause.
4. Subscriptions & Billing
Subscriptions are billed monthly or annually at the rates displayed on the Platform (currently Premium at RM 129/month or RM 1,290/year, and VIP at RM 149/month or RM 1,490/year). Subscriptions auto-renew until cancelled. Payments are processed through third-party payment gateways. Prices are exclusive of applicable taxes, which may be added where required by law. We may change prices with reasonable notice.
5. Cancellation & Refunds
You may cancel your subscription at any time. Cancellation stops future billing and you keep access until the end of the paid Billing Term. Refunds are handled under our Refund Policy (daily proration, immediate revocation of access).
6. Intellectual Property
All Content is owned or licensed by the operator of the Platform. As a Member you receive a personal, non-transferable, revocable licence to access Content for your own personal use. You may not scrape, redistribute, forward, screenshot for republication, or feed Content into AI or training systems.
7. Acceptable Use
You agree not to use the Platform unlawfully, resell access, circumvent any technical measures, harass other members in community spaces, or present Platform Content as your own analysis.
8. Third-Party Services & Links
The Platform may link to brokers, payment gateways, data providers and other third parties. We are not responsible for third-party terms, services or content.
9. Disclaimers & Limitation of Liability [LAWYER]
The Platform and all Content are provided "as is" and "as available". To the maximum extent permitted by law, our total liability to you is limited to the fees you paid in the twelve (12) months preceding the claim. We are not liable for indirect or consequential loss, including trading losses.
10. Indemnification
You agree to indemnify the operator of the Platform against claims arising from your misuse of the Platform.
11. Termination
We may suspend or terminate your access for breach of these Terms. On termination, your access to Content ends and we may delete your data in accordance with our Privacy Policy.
12. Governing Law & Disputes
These Terms are governed by the laws of Malaysia. Any dispute will be subject to the exclusive jurisdiction of the courts of Malaysia.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you by email or on the Platform. Continued use after changes take effect constitutes acceptance.
14. General
If any provision is unenforceable, the remainder stays in force. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and the operator. The English version of these Terms prevails; a Bahasa Malaysia version may be provided for convenience.
